INDY LTE: County should take interest in fly ash recycling

To give some background, in January 2007, Mirant had an application before the Maryland Public Service Commission. The current board of county commissioners was invited to participate as an interested party during the hearings. Commissioners’ President Wayne Cooper initially declined the invitation. However, he later admitted that the commissioners knew little about the subject and they were uncomfortable at the prospect of holding a joint hearing and so declined to participate.

I am planning to file as an interested party on this application and am curious whether our commissioners will do the same — this time. I certainly would like to see the current commissioners take an interest and ensure all traffic safety concerns are addressed.

  • 1. · Of course the commissioners did not attend the meeting in Hughesville. The commissioners have absolutely no grasp of any of the issues related to Mirant. You should hear them try to explain both potable and desalinized water much less recycled fly ash. My guess is they WILL weigh in as an “interested party” in this case because there is an election this year.

  • 2. · For the record, the Indy changed my wording, slightly, which changed some of the intended meaning.

    Commissioners' President Wayne Cooper initially declined the invitation.
    My original letter stated "Cooper initially denied receiving the invitation."

    Cooper lied to The BayNet reporter, Anna Dailey, about having been asked to participate. A BayNet reader, Cheryl Thomas, quickly located the invitation from the MD PSC, along with the response from the county declining to participate, supplied it to The BayNet, and another article was posted titled "Cooper Mis-Represented to The BayNet" (something to that affect.)

    Just wanted to set the record straight.

  • 3. · At a town hall meeting at Swan Point in February of 2007 hosted by those opposed to Mirant's expansion plans and the Charles County delegation to Annapolis, all five commissioners attended. Not one of them said a word. The meeting was co-moderated by Delegate Murray Levy and me.

    Sam Graves mistakenly signed the list of those wishing to speak. When called on by Murray Levy, he exclaimed "I don't wish to speak. I wouldn't know what to say." I think that said it all in 2007 as well as today.

  • 4. · #2 - Great letter!

    The following are excerpts from a letterI sent to The Baynet & the Indy, but the Indy didn't print it:


    "On January 23, 2007, the Maryland Public Service Commission sent a letter to Commissioner Cooper and Mr. Roy Hancock, the Interim County Administrator, inviting both of them to attend a Public Hearing regarding Mirant’s request for a Certificate of Public Convenience and Necessity (CPCN) to install air quality control equipment.

    The application was docketed as Commission Case No. 9085.

    However, in a letter to the Public Service Commission dated January 30, 2007, Acting Administrator Hancock, DECLINED the invitation to participate in the public hearing and NONE of the Commissioner’s signed this most important letter.

    This decision not only indicates the Commissioner’s lack of interest in the matter, but it resulted in the Commissioner’s waiving their right to hold the hearing jointly with the PSC thereby giving up their right to question Mirant on behalf of their constituents – the citizens of Charles County!

    In fact, Commissioner Cooper said this issue was “completely out of their league” and that the Commissioners “really were relying on the State to make a good decision”.

    Commissioner Cooper also said they felt “uncomfortable” at the prospect of holding a joint hearing when they “knew so little about the subject”.

    Sure doesn't sound like the Commissioners are all that concerned about Mirant, does it?
