Opinion by Zarnoch, J. (WSG)

In this Charles County zoning case, we are asked to consider the due process and open meetings limitations on a site visit of the affected property by members of a county board of appeals. This issue arises with respect to the 2009 grant of a special exception to appellee WSG Holdings, LLC (“WSG”), for construction of a “research facility” in Nanjemoy, in Charles County.

JUDGMENT REVERSED . CASE REMANDED TO THE CIRCUIT COURT FOR CHARLES COUNTY FOR REMAND TO THE BOARD OF APPEALS FOR PROCEEDINGS CONSISTENT WITH THIS OPINION. COSTS TO BE PAID BY APPELLEES.

  • 3. · YES - Remanded means a NEW proper hearing, including cross examination of the applicants, AND the County persons in support of this project at least, if the County doesn't do some soul searching and decide to re evaluate the Application.

    At this point, we have the Circuit Court which remanded it solely for the purpose of reviewing compliance with the Charles County Comprehensive Plan.

    The State Court of Special Appeals ads that, the SITE VISIT was an illegal closed meeting, and NOT in compliance with the Open Meetings ACT.

    It only took one issue to kick it back down, ALL the other issues can now at least be addressed in a New Hearing. Meanwhile.. WSG is already technically "in business" on Liverpool Point Road with Washington Field - http://www.washingtonfield.com - running a commercial USE, private Airport with a Commercial Sign ! The county needs to explain this.

    Ken Robinson was on the BOA when this was heard and recused himself because he had done some work for WSG. He has apparently decided since then that the work was done and paid for years ago. I think many would agree.

    Luke Hannah said this would be good for Nanjemoy. We must never forget that. If he ever runs for Commissioner or anything else.

Would it make sense for Mower and Hannah to recuse themselves along with any other BOA member who sat in the first time around?

    I think that is a fair question - we shall see how it shakes out.. to me, the COUNTY should re evaluate this whole mess - Citizens have NOTHING against the new regime, except that - they were advised to stick with the OLD regime strategy -- but they should most def scrutinize the entire application, maybe we can avoid a re hearing@?

    I for one am all for that -- the Million Dollar Question is - WHAT DOES THE COUNTY DO NOW?!

    Citizens demanded and GOT an outside opinion, and the ruling was to let this run its course in the COURTS first. Well, we did that.

    Now, will they hide behind the same claim of the quasi judicial proceeding cannot be approached?

    - What about doing an INTERNAL review of the PGM that the BOCC DOES have control over?!

    - What about a LEGAL review of the County position by fresh new minds, that may not be intimidated.. i.e. (I quote from CQKs letter to Nanjemoy...):

    "We had hoped to be able to discuss the issue again, although it’s in the judicial system, but the County Attorney’s Office has expressly instructed us not to do so. We were advised that “…any involvement with the pending decision of the Maryland Court of Special Appeals at this point in time could have legal repercussions beyond the exposure limitations of our county/government.

    - What about an INTERNAL review of the Commercial permit issued to a Commercial Company for a Commercial Sign on a residential lot, for the former private, personal use ONLY airpark.. Parks Airpark - now known as Washington Field?!!

    Citizens PIA questions were NEVER answered as well, before the entire legal staff "retired" - where is the original PLAT from 1960 to support the granting of this airpark. THEY COUNDT FIND IT !! You know why - because that original airpark strip, is on the Parmley property - NOT the WSG plot now using that permit.

    -How did the FORMER head of PGM, with just a letter - give reaffirming use to WSG and AL Moran without ANY Public, or BOCC review on the Matter, and ONLY based on Al Morans Sworn affidavit, and some 2008 Land swap plat that applicants provided.


    THIS mess is FAR FROM OVER if WSG intends to RE APPLY. One Candidate that was running for office, told the Nanjemoy Town Hall, that she would at least have a conversation with this applicant, and would maybe suggest they put this else-where. Lets see if she sticks to her word. Ill put the clip up on YOUTUBE later.

    We believe we’ve done all we are allowed to do under the law and the rules and procedures, which the Court requires us to follow. We will await the decision of the Court and, in the meantime, we will be examining procedural rules for all of the County’s appointed boards and commissions, in conjunction with the Office of the County Attorney.


    So, here we are.

    We simply ask for a FULL ADMINISTRATIVE REVIEW, and that the applicant must re apply, and the application needs to be more thoroughly reviewed for intended/actual use, as opposed to claimed use - so mistakes of the past can be avoided.

    And please take that awful Commercial SIGN down on Liverpool Point Road
    - that makes it appear WSG is already in business in Nanjemoy, on a RESIDENTIAL LOT - as they claim...here.

  • 16. · I would also like to make it crystal clear, that we ran the Re-Elect NO ONE campaign in 2010 as a direct result of the former Commissioners position on this matter.

    We are VERY happy we at least got 4 NEW commissioners in office, and specifically, that Candidate Ken Robinson said at a public meeting in Nanjemoy as a County Commissioner that he witnessed inappropriate behavior by the county on the WSG case when he was on the Board of Appeals. He subsequently brought it up before all the commissioners who ultimately voted 3-2 to seek a second legal opinion.

    Well, the way Mr. Mudd worked the land split in 2008 between the Parmleys and Moran, it only gave them right of way UNTIL WSG purchased the land, which occured in Feb.. 2011. Note: They put the fence up in Oct. of 2010 and the Commercial Sign -- of course, the COUNTY did nothing regardless of massive citizen inquiries.

    WSG doesnt give a spit about the Parmleys Farmhouse being cut off from the Road, or the Jentilets, or ANY neighbor down here.

  • 18. · TWO additional items I can now share, from State COSA mediation, that made us double down on NO COMPROMISE.. and even more determined to get justice.

    1. CEO of WSG admitted that they plan to do training, he said that he said so in the hearing (and he did). (regardless of the so called "condition" of research only.) and that he would FLY in clients for courses, that's Commercial USE of the airpark.

    2. County Asst Atty said there "is ZERO change of getting a different decision from the BOA if this gets remanded back to the County". We brought up that this is an election year, and you never know what can happen, and the board members change as well.

    All opposition was seeking was a fair hearing IAW the BOA rules and procedures, as requested in a "Motion of Appropriate Relief" filed March 27, 2009.

    Its interesting he stated that "this site is surrounded by hundreds of acres so is the perfect location for this type facility"

    What he does not mention that ALL of those surrounding HOME owners were there against this project and WSG, nor the COUNTY own this land!

    And the fact, that as you can see above, EVEN a year after granting the BOA approval restricted to RESEARCH ONLY, after the CC Circuit Court struck it down, the COUNTY continued to brag about the economic benefits of this TRAINING center. Go figure.

    In the end, I think the Board of Appeals did the best they could, Mr. Mudd put on a convincing case, but it was obvious on the final night, that this would be a 3-2 either way. And an appeal was imminent either way. I appreciate the BOA members volunteering their time to serve on this board.

    Your idea has merit. Considering what's surfaced so far due to the former head of PGM not following regulations, the whole WSG process should be reexamined. Enough has come out to question the process--it's the same idea as those folks in Bookwood Estates who involved the commissioners about a large developement that was going to run all traffic through their subdivision. Due to not following APFO regs, it never should have been approved.

    I don't see a difference. A screw-up is a screw-up, and there has been enough proof that WSG has been nothing if not a major screw-up. Do the PGM review.

It is probably best not discussed here, but remember, the staff works for the Commissioners. So does the County Attorney. I suspect the new ones know that, as opposed to the former one acting at times as if the Commissioners worked for him.

  • 27. · I doubt WSG had anything to do with Mr. Fink and Mr. Buchanan retiring, there are so many, MANY issues at the County to deal with -- that when there is a Leadership change, there is naturally a philosophy change in how they serve the County. That is the genius of democracy.

    That being said - Yes, lets hope that this new BOCC knows that THEY are the Boss, THEY are elected - THEY must Lead.

    I know two of them are lawyers, and I often rag them, but they really do know law, so they are naturally more cautious. I hope this new BOCC can find a consensus on this issue at Washington field, and the WSG Training Camp. We dont need OVERT spooky ops down here, and the people have spoke. We need the Leadership !

    What is more important - a few pennies in ECODEVO, or coming to the realization, that Najemoy is a GOLD MINE (Green Mine) - if they can just protect and preserve this last stand of rural Maryland, they will be heros, years after they are gone.

    The peninsula of Nanjemoy is very very unique. We have much bigger problems to deal with, and together, we can deal with it, but divided, it only becomes a force multiplier for chaos and opportunist.

    I would encourage the Commissioners to embrace the Nanjemoy Vision Plan - and include consideration for it in the 2012 Comp Plan.

    Lets get some low/no impact alternative energy RESEARCH farms going, lets get indoor plumbing to those that want it, lets pull together and optimize all the Parks (Creds to the last BOCC for creating Douglas Point Park, and Mallows Bay Landing Boat Launch) the County and State have put down here ! Eco and Historical Tourism would be wise.

    How many of you KNEW that the First Black Regiment of the Union Army was placed in Nanjemoy - at Trappe, which is now the intersection of Rt. 6 and Taloes Neck Road. Thats pretty cool, and gets no attention.

    OR - that we held German POWs in Nanjemoy off 224, some of which went out to work local farms, and chose to stay behind if they could.

    The history is RICH, the Land is Precious. Lets Preserve, and Protect Nanjemoy !

    If the Commissioners follow there own objectives they will support the WSG project as it will benefit the county as a whole. The commissioners should act as they represent the entire county and not cave to the political elitist minority of the privileged incumbents club and actually support business. Or will they once again cave to the incumbents club as they claim that this attempt to build a facility that will serve national security and increase our tax base is a vulgar imposition on the land that only benefits a greedy defense contractor. This should be an interesting one to watch.

    Scratching my head here trying to figure out why the commissioners should support WSG if the process has been compromised by poor decision making before they came on board. They'd be nuts to back WSG until PGM completes a full, in-depth examination of the WSG process.

    Seahorse - You are obviously a "political elitist minority" for suggesting such things...

    The Marxist strategy professed by Franklin aside, this was an illegal process, as proved by the State Courts. If YOU are a training facility, just say so, and lets have a ZTA hearing to allow training on an AC/RPZ. Lets see the votes on that move! Not to mention the commercialization of a private, personal use airpark - thats another battle.

    But don't hide behind the facade of a "research facility without the processing of materials" title, just to get your NUT. Talk about blind squirrels...

    I have no clue on who franklin is, but now i am very curious. BUT this not about persona, its about ideas. I'm an Ayn Rand kind of guy, free enterprise, and capitalism rule, but following the rule of law, and the Village rules - when it affects the Village. NOT the collective greater good crap he/she stated.

    Our own local person, Cornell Posey had a logical idea to provide affordable housing, yet was SHUT DOWN based on spot zoning. This outsider shell company, (Global Tactical Solutions, Washington Security Group, and whatever comes next) comes in with big promises, leaning on the national security argument, w legal intimidation.. and gets approved. Whats wrong with this picture?

    can you prove to anyone that this will serve national security, and increase our tax base.. show me the data! no really, show the data!

    Do you KNOW what the total DoD/Government contracts of WSG Holdings LLC are? ZERO is the answer, and will always be the answer, WSG Holdings LLC HAS no contracts. NONE.

    Okay, so lets trek back to Washington Security Group Inc.. they have , on record a 420K gig with the Naval Post Grad school...in 2006... that its. These things are tracked for a reason.

    I'd bet on Collins voting for it because it all came about on his watch while on the Cooper/Patterson BOC, and he seems to think what that BOC did is beyond question--go figure. But, Davis? Hard to say. IF she really cares about her D2 constituency, she'll grab this bull by the horns and wrestle it to the ground: She'd confer with Kurt Wolfgang (lawyer to lawyer); she'd hold a meeting in Nanjemoy at the community center for all interested; she'd request firmly that PGM do an in-depth WSG examination; she'd wade into the WSG swamp using everything her position of commissioner allows her and then some, because why? Because it's the right thing to do for those you represent.

    So all are clear, the Commissioners are not voting on this matter, and never will. It is up to the Board of Appeals to deal with special exceptions, without political distraction.

    However, the Commissioners are in charge of the County Staff and must ensure that the County has done due diligence on ANY matter. That includes PGM, Planning staff, and County legal staff. I would add the Commissioner for any district has the job to communicate with the constituents without interference as well.

    I think there was a breakdown in this understanding with the former BOCC, that took counsel to remain mum on the matter.

    And I for one appreciate Franklin joining in the debate. He has good points about the need to attract business that I agree with. But some of us feel it should be in the Development zone, not in Rural nanjemoy. And with this particular issue - it started in 2006 when they told the truth, came in, and proposed a training center. It didnt take long for citizens to find out Training centers are not allowed in an AC/RPZ. So the applicant withdrew.

    in 2008, the applicant claimed a Research Facility, yet its own GSA contract, web sites, and public records indicate they were already marketing "Washington Field" in nanjemoy as an outdoor training center.

    I think the Judges at the State level well understood this, but didn't even need to address that fact, as the BOA process had irregularities that earned a remand.

    So we expect to go back to square one, but this time, opposition fully understands the Rules and Procedures of the BOA, so the outcome, might be different.

    There is a NIMBY element, as Nanjemites are spoiled with a beautiful, peaceful, quiet undeveloped peninsula in Nanjemoy, that all of us LIVE here for. But following the rule of law, and not the rule of man... is the point of THIS opposition. No one wishes WSG ill will, I hope they create a dynamic, profitable training center - somewhere in Charles County that is properly ZONED for it

    That's the key - ZONING!! It's obvious that Nanjemoy or any of the other AC zoned areas are not conducive to a facility that would conduct reaseach AND training complete with a driving course for night driver TRAINING.

    I also agree that franklin has some good points, BUT I'd still like for him to explain WHY he thinks WSG would benefit the county... All I see is that it would result in even LOWER PROPERTY VALUES!

If he wanted to expound on this: If the Commissioners follow there own objectives they will support the WSG project as it will benefit the county as a whole. he would make a compelling arguement as to why WSG is so necessary to the vitality and economic health of Charles County. Rather he digs in with silly labels almost like he's taking it personally that WSG has been remanded back to the CC BOA.

    I cant speak for Franklin, but if you go by the testimony of WSG, they promised 2500 room nites per yer, (thats 50 "researchers" per week) Plus the restaurant business, etc that would accompany them.

    Also, after the hearing, they say that this will employ 8 persons w an average salary of $65k year for this training facility. Plus a mix of consultants that come to this training center.


    All I see is that it would result in even LOWER PROPERTY VALUES!


    I agree, the properties within a couple of miles, and on Liverpool Point Road at least, and especially the Parmley Estates would be decimated. Who in their right mind would want to live near this racket.

    On a residential lot. I wonder if the whole training thing was just a distraction to take over the private, personal use airpark in the background. (exactly what they did)

    And that would beg to question, what exactly are they doing in Nanjemoy. Is this come kind of bail out spot, for VIPs to get out of DC? A staging area for exercise and wargames? The helicopter flight times chart is interesting, as is the Tactical Night Lighting feature.
